This Privacy Policy explains how Rainwater Exchange, Inc. (“we,” “us,” or “our”) collects, uses, shares, and protects information when you visit rainwaterexchange.com (the “Site”), purchase from our online store, or enroll in a maintenance plan. It also describes the privacy rights you may have and how to exercise them. By using the Site or our services, you agree to this Policy.
1. Information We Collect
We collect the following categories of personal information, directly from you and automatically through the Site:
Identifiers and contact details — name, email address, phone number, and billing and service address. Source: you. Purpose: orders, plans, communication.
Maintenance plan and property information — details about your rainwater or water storage system and service history. Source: you and our service visits. Purpose: to provide ongoing maintenance.
Commercial information — products and plans you purchase and your order history. Source: you. Purpose: fulfillment and recordkeeping.
Payment information — a payment method kept on file with our processor for recurring billing. We do not store full payment card numbers on our own systems. Source: you, via our processor. Purpose: processing payments.
Internet and device information — IP address, device and browser type, and pages viewed, collected through cookies and similar technologies by our website provider, Squarespace. Source: automatic. Purpose: to operate, secure, and improve the Site.
We do not intentionally collect sensitive personal information (such as government IDs, health, or biometric data) and ask that you not send it to us.
2. How We Use Your Information
We use personal information to:
Process orders, payments, and maintenance plan enrollments and renewals;
Schedule, perform, and follow up on maintenance and service visits;
Communicate with you about your orders, plans, renewal reminders, and support;
Operate, secure, troubleshoot, and improve the Site and our services; and
Comply with legal, tax, and accounting obligations and enforce our terms.
3. Cookies and Tracking Technologies
Our Site is hosted on Squarespace, which uses cookies and similar technologies that are necessary for the Site to function and to keep it secure, as well as cookies that help us understand how the Site is used. You can control or disable cookies through your browser settings, though some features may not work without them. We honor recognized opt-out preference signals, such as Global Privacy Control (GPC), where required by law.
4. How We Share Your Information
We share personal information only as needed to run our business, with the following categories of recipients:
Service providers — Squarespace (website hosting and online store), Stripe and Squarespace Payments (payment processing and recurring billing), and Cal.com (appointment and visit scheduling). Some of your information necessarily resides in these providers’ systems so they can perform their services, each under its own privacy and security practices.
Independent installers — if you ask us to refer a repair or other out-of-scope work, we may share limited contact and system information with an installer in our network to coordinate that referral.
Legal and safety — when required by law, to respond to legal process, or to protect our rights, customers, or property.
Business transfers — in connection with a merger, acquisition, or sale of our business, subject to this Policy.
5. We Do Not Sell Your Information
We do not sell your personal information, we do not share it for cross-context behavioral or targeted advertising, and we do not use it for profiling that produces legal or similarly significant effects. We have not done so in the preceding 12 months. We share information only with the service providers and in the circumstances described above.
6. Payments
Online store purchases are processed through Squarespace Payments, powered by Stripe, and maintenance plan payments are processed through Stripe. These processors handle your payment card information under their own terms and security standards. For recurring maintenance plan billing, your payment method is securely stored by our processor so scheduled charges can be made; we retain a secure reference rather than your full card number.
7. Data Retention
We keep personal information for as long as needed to provide our services, maintain your plan and service history, and meet legal, tax, and accounting requirements. When information is no longer needed, we delete or de-identify it. Records held by our processors are retained under their own schedules.
8. Data Security
We take reasonable administrative and technical measures to protect personal information and rely on the security practices of established providers such as Squarespace and Stripe. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
9. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
Access / know — request confirmation of whether we process your information and a copy of it.
Correct — request correction of inaccurate information.
Delete — request deletion of your information, subject to legal exceptions.
Portability — obtain a copy in a portable format.
Opt out — opt out of any sale, targeted-advertising sharing, or significant profiling (note: we do none of these).
How to exercise. Email us at hello@rainwaterexchange.com with your request. We will verify your identity by matching the information you provide against our records and will respond within the timeframe required by law (generally 45 days, with an extension where permitted). You may use an authorized agent, who must show permission to act for you. We will not discriminate or retaliate against you for exercising your rights.
Appeals. If we decline your request, you may appeal by replying to our response or emailing hello@rainwaterexchange.com with “Privacy Appeal” in the subject line. We will respond to the appeal within the period required by law and explain our decision. If your appeal is denied, you may contact your state attorney general.
10. State-Specific Disclosures
Texas residents. Under the Texas Data Privacy and Security Act, you have the rights described in Section 9, including the right to appeal. We do not sell personal data or sensitive data, and we do not process personal data for targeted advertising.
California residents. Under the CCPA/CPRA, you have rights to know, delete, correct, and opt out of sale/sharing. We do not sell or share personal information as those terms are defined, and we do not offer financial incentives for personal information.
Other states. Residents of other states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, and Oregon) have comparable rights, which you may exercise as described in Section 9.
11. Children’s Privacy
Our Site and services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13; if you believe a child has provided us information, contact us and we will delete it.
12. Where Your Information Is Processed
We operate in the United States, and your information is processed and stored in the United States by us and our service providers.
13. Third-Party Links
Our Site may link to third-party websites or services we do not control. Their privacy practices are governed by their own policies, and we are not responsible for them.
14. Changes to This Policy
We may update this Policy from time to time. We will post the updated version here with a new “Last updated” date, and material changes take effect when posted. Your continued use of the Site or our services after an update means you accept the revised Policy.
